(1) The person is not more than four (4) years older than the victim. However, Indiana has a "Romeo and Juliet" defense that provides a defense to a charge of Sex Misc if ALL of the following apply: If some one who is at least eighteen engages in sexual activity with someone who is at least 14, but less than 16 years old, the offense is Sexual Misconduct With a Minor ("Sex Misc"). The LAW only cares that if there is SEXUAL ACTIVITY involved, that both parties are old enough to give consent LEGALLY. The LAW doesn't care about age if you are "dating" in the old-fashioned platonic sense.
